Official Rules for the Gerber® 2026 Photo Search Contest
No Purchase Necessary. A Purchase Will Not Increase Your Chances Of Winning.
- Eligibility: This Contest is only open to individuals who are, as of the date of entry, (a) legal residents of one (1) of the fifty (50) United States, the District of Columbia, or Puerto Rico (b) currently be residing in one (1) of the fifty (50) United States, the District of Columbia or Puerto Rico, (c) at least eighteen (18) years of age, or the age of majority in the entrant’s state of residence (which is nineteen (19) years in Alabama and Nebraska, twenty-one (21) in Mississippi and Puerto Rico, and eighteen (18) in all other states) at the time of entry, and (d) the parent(s) or legal guardian(s) of a child that is between one (1) day and sixty (60) months old as of the date of entry (an “Eligible Child”). Employees of Gerber Products Company (“Sponsor”), Nestlé USA, Inc., Brandmovers, Inc. (“Administrator”) or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Contest (collectively with Sponsor and Administrator, the “Contest Entities”), and any of their respective parent and affiliate companies or subsidiaries, as well as the immediate family (spouses, parents, and step-parents, siblings, and step-siblings, and children and step-children, and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to enter or win.
- Entry Period: The Entry Period starts at 12:00:00 AM Eastern Standard Time (EST) on Monday, March 2, 2026, and ends at 11:59:59 PM Eastern Daylight Time (EDT) on Sunday, April 12, 2026 (the “Entry Period”).
- Create Your Entry: To create your entry, you must create the entry by: (a) taking a picture of your Eligible Child (“Photo”); and (b) writing a brief story/essay about the moment captured in the photo and what about it captures the joy of parenthood and makes it special to be recognized (“Written Submission”) The entry form, Photo and Written Submission are collectively hereinafter, an “Entry.” Entries must comply with the Entry Requirements set forth below to be considered an eligible Entry. Sponsor reserves the right to disqualify any Entry that does not meet the Entry Requirements, as determined by Sponsor in its sole discretion. Please note: all Entries will be automatically put into one of the following two categories (each, a “Category”), based on the age of the Eligible Child, as follows: the “Baby Category” is for Eligible Children ages 0 to 36 months; and the “Get’ems! Category” is for Eligible Children ages 37 to 60 months.
- Entry Requirements:
Your Entry must meet the following requirements:
- You (or an immediate family member) must take the photo of your Eligible Child during the Entry Period. You may not have a hired photographer or other person take the photo of the Eligible Child.
- Your Entry may only include – one (1) Eligible Child or (1) set of multiples (i.e., twins, triplets).You must be the parent or legal guardian of the Eligible Child in the Entry.
- The child in the Entry must be appropriately clothed. Sponsor will not accept Entries with children who are not clothed. Bathtub and diaper photos will not be accepted.
- You may not use any filters and you cannot edit or retouch your Entry.
- The use of A.I. (Artificial Intelligence)in any way including to create or alter a photo or write the written submission in your Entry is not allowed.
- The Entry may not depict the Eligible Child in an unsafe or inappropriate manner.
- The Entry may not prominently feature any third-party trademarks, logos, or artwork. Moreover, it may not violate anyone’s rights, including, but not limited to, copyrights or trademark rights. You must have all rights and permissions to submit and share your Entry.
- The Entry may not portray Sponsor or its products in a negative light or contain any content that is inappropriate or indecent, as determined by Sponsor, in its sole discretion.
- Entries must be sent from unique email addresses. If submitting more than one Eligible Child, please use a unique email address for each Entry.
- How to Submit Your Entry:
Once you create your eligible Entry, to enter, visit
photosearch.gerber.com (“Website”) during the Entry Period, fill out the entry form, and submit your
Entry. There is a limit of one (1) Entry per Eligible Child. (If you have more than one (1) Eligible Child, you
can submit a separate Entry for each Eligible Child.) Sponsor reserves the right to disqualify any individual
that attempts to enter more times than allowed in these Official Rules, or who otherwise violates these
Official Rules. ALL Entries must be submitted by 11:59:59 PM EDT on April 12, 2026, to be counted as a
valid Entry.
By entering, you represent and warrant that your Entry complies with all Entry Requirements set forth above and, including but not limited to you having the rights necessary to grant Sponsor the rights to your Entry as described in the Entry Requirements and these Official Rules. Further, by entering, you indicate your agreement to these Official Rules and Sponsor’s decisions regarding the Contest, which are final and binding. Winning the Grand Prize is contingent upon fulfilling all requirements in these Official Rules. - Sponsor’s Rights to Entries: You do not transfer ownership of your Entry by entering the Contest. However, by entering, you grant Sponsor, its agents, licensees, and assigns, an irrevocable, perpetual, non-exclusive right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you.
- How the Winner is Selected/Judging:
During and after the Entry Period, a diverse panel of judges
selected by Sponsor, including Gerber and Nestlé employees and contractors (the “Judging Panel”) will
evaluate all eligible Entries. There will be three (3) phases of Entry review and judging as follows:
- Phase 1: All Entries will undergo an initial review by the Judging Panel during “Phase 1” which will occur starting from March 2, 2026, through April 2026 (“Vetting Period”). During Phase 1, each Entry will be evaluated and either accepted or rejected based on a reasonable review process to determine whether it violates the Entry Requirements set forth in Official Rule #4. Examples of disqualifying issues include the use of AI-generated or AI-assisted images, retouching or editing beyond what is permitted, inclusion of third- party logos or trademarks, or images depicting the Eligible Child in an unsafe or inappropriate manner. All accepted Entries in the Baby Category, and all accepted Entries from the Get’ems! Category will proceed to having the Judging Panel evaluate the Photo Submission part of the Entry and given an overall score. The overall score the Judging Panel will use is on a 15-point total scale (collectively, the “Semi-Finalist Judging Criteria”), as follows: Authenticity (5 Points), Natural Emotion (5 Points) and Clarity of Moment (5 Points). Please note: Notwithstanding the foregoing, no Entry will be stored after the Contest ends, nor used in the future for any purpose unless the Entry is deemed the Grand Prize winning Entry.
- Phase 2: All Entries with an overall score of 14 in Phase 1 will move on to Phase 2, which will occur starting from March 2, 2026 through April 2026 (“Finalist Judging Period”). During Phase 2, the Judging Panel will evaluate the Phase 2 Entries in the Baby Category, and the Phase 2 Entries from the Get’ems! Category weighing 50% of the overall score based on the Written Submission part of the Entry and 50% of the overall score based on Overall Impression of the Entry. The overall score the Judging Panel will use is on a 30- point total scale (collectively, the “Finalist Judging Criteria”), as follows: Storytelling (5 Points), Alignment to Gerber Parent-Friendly Commitment (5 Points), Impact (5 Points) Cohesion (5 Points), Memorability (5 Points), and Emotional Resonance (5 Points). The top 250 scoring Entries from the Baby Category and the top 250 scoring Entries from the Get’ems! Category using the preceding Finalist Judging Criteria will be deemed the Finalists and will advance to Phase 3 for additional judging. In the event of a tie, the Entry with the higher percentage of the overall score based on the Photo submitted will be deemed the Finalist from among all tying Entries.
- Phase 3: Then, by May 2026 through May 18, 2026 (“Grand Prize Judging Period”) the Judging Panel will re-evaluate all eligible Finalist Entries in the Baby Category, and all eligible Finalist Entries from the Get’ems! Category weighing 35% of the overall score based on the Photo, 35% of the overall score based on the Written Submission and 30% of the overall score based on the overall impression of each Finalist’s Entry. The overall score the Judging Panel will use is on a 45-point total scale (collectively, the “Grand Prize Judging Criteria”) as follows: Authenticity (5 Points), Natural Emotion (5 Points), Clarity of Moment (5 Points), Storytelling (5 Points), Alignment to Gerber Parent-Friendly Commitment (5 Points), Impact (5 Points), Cohesion (5 Points), Memorability (5 Points), and Emotional Resonance (5 Points). The top scoring Finalists from the Baby Category and the top scoring Finalists from the Get’ems! Category will be considered potential winners and will be contacted by e-mail or via a direct message sent to the potential Grand Prize winner’s email from Gerber’s official email, on or about May 18, 2026. Please note: Gerber will never reach out from an unverified social media handle or ask you for your credit card information or other payment details. The top scoring Finalist from the Baby Category and the Top scoring Finalist from the Get’ems! Category that successfully completes the potential winner requirements as set forth in Official Rule #8 will each be deemed the Grand Prize winner of their Category and will each receive their Category’s Grand Prize, subject to verification. In the event of a tie, the Finalist with the higher percentage of the overall score based on the Photo submitted will be deemed the Finalist from among all tying Finalists.
- Potential Winner Requirements: Each potential Grand Prize winner may be required at Sponsor’s sole discretion to execute and return an Affidavit of Eligibility, a Publicity and Liability Release, where legal, and a W9 tax form, along with an authorization to conduct a background check as described in Official Rule #9 below (collectively, “Documentation”). Both parents of a child included in a potential Grand Prize winning Entry may be required to agree to and execute the Affidavit of Eligibility and the Publicity and Liability Release, or submit documentation for verification of sole legal custody. Sponsor reserves the right to disqualify a potential Grand Prize winner if he/she/they does not sign and return the necessary Documentation within five (5) business days of the date the documents are originally sent to the potential Grand Prize winner or if Sponsor (in its sole discretion) determines that, based on the results of the background check , the potential Grand Prize winner will not be a suitable representative for the Gerber brand (as set forth in Official Rule #9 below). If a potential Grand Prize winner is disqualified for any reason, the second highest scoring Finalist from the Grand Prize Judging Period will be deemed the alternate Grand Prize winner for that Category, and that alternate potential Grand Prize winner must then successfully complete the preceding winner requirements in order to be named the official Grand Prize winner.
- Background Checks/Due Diligence Permission:
Each potential Grand Prize winner hereby
authorizes Sponsor and its designated agents and representatives to conduct a comprehensive review of
potential Grand Prize winner’s background (the “Background Check”). As such, potential Grand Prize
winners understand that they will be asked to provide their social security number, or similar identification
number, addresses or residences from the last seven (7) years, date of birth, prior names (e.g. maiden
name) and any other information necessary for Sponsor to conduct a Background Check of the potential
Grand Prize winner. The scope of the Background Check may include, without limitation, civil and criminal
history records from any criminal justice agency in any or all federal and state records, sex offender
registry check, and terrorist watch list check. Each potential Grand Prize winner agrees in order to be
eligible to be deemed the official Grand Prize winner of that Category, they must provide all personal
information needed for Sponsor to conduct the Background Check as set forth above, and agrees to sign
releases or authorization forms as part of the Documentation in order to permit Sponsor to conduct the
Background Check and Due Diligence. Sponsor and its designated agents and representatives shall
maintain all information received from this release and authorization form in a confidential manner in
order to protect a potential Grand Prize winner’s personal information.
Sponsor reserves the right, in its sole discretion, to disqualify a potential Grand Prize winner for any of the following reasons: (a) non-compliance with these Official Rules; (b) in the event that the potential Grand Prize winner notification is returned as undeliverable; or (c) Background Check indicating a history, characteristic or quality considered by Sponsor to be unacceptable in a potential Grand Prize winner in this Contest. - Prize: Two (2) Grand Prizes (one (1) per Category):
- Baby Category Grand Prize: A $50,000 USD check awarded to the winner of the Baby Category (ages 0 to 36 months) made out to the Eligible Child’s parents or legal guardians who submitted the winning Entry; and $2,000 in Gerber Childrenswear to be awarded via discount codes to be delivered in four (4) seasonal wardrobe drops over a 12-month period (seasonally) to be delivered to the Grand Prize winner on or about April 1, 2026, July 1, 2026, October 1, 2026 and January 1, 2027. Total ARV of Baby Category Grand Prize: $52,000.00.
- Get’ems! Category Grand Prize: A $10,000 USD check awarded to the winner of the Get‘ems! Category (ages 37 to 60 months), made out to the Eligible Child’s parents or legal guardians who submitted the winning Entry; and $500 in Gerber Childrenswear to be awarded via a single discount code on or about April 1, 2026. Total ARV of Get’ems! Category Grand Prize: $10,500.00.
In addition, in consideration for accepting the Grand Prize, the Baby Category Grand Prize Winner agrees to serve as the 2026 Gerber Baby and the Get’ems Category Grand Prize Winner as the 2026 Get’ems Winner for up to one (1) year from the date of being named the official Grand Prize winner.. As part of this role, each Grand Prize winner will be required to (i) participate in up to eight (8) media interviews inclusive of live reveal moment on national broadcast program, (ii) participate in content creation for up to twenty (20) social media posts on Gerber channels, (iii) participate in up to three (3) live and/or virtual appearances for content creation to be used for media and social use, and (iv) grant Sponsor the rights to use baby’s name, image, and likeness for promotional purposes in connection with this campaign. Participation in any content, posts, appearances, and media interviews, including any live reveal moments on national broadcast programming, is at Sponsor’s sole discretion.
Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion. Winners are solely responsible for paying all local, state and federal taxes associated with accepting the Grand Prize and any other costs not listed above. The Sponsor will submit a 1099 to proper tax authorities for the Grand Prizes. - General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prize according to the procedures set forth above from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited.
- Release and Limitations of Liability: By entering, you agree to release and hold harmless the Contest Entities, their parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related that may impede entry; (c) any claim or allegation that your Entry infringes any copyright, trademark, or any other intellectual property right; (d) lost, late, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- Privacy and Publicity: Any information you submit as part of the Contest will be treated in accordance with Sponsor’s Privacy PolicyPrivacy Policy located at www.gerber.com/privacy-policy. Except where prohibited, participation in the Contest constitutes your consent to Sponsor’s use of your name and Entry for promotional purposes in any media without further payment or consideration.
- Disputes: Entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, other than those concerning the administration of the Contest or the determination of the winner or for any disputes arising from the loss or injury from the accepting a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules shall be submitted to final, binding arbitration conducted in the Commonwealth of Virginia under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Virginia state or federal court judge with experience in entertainment matters who shall follow Virginia law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Commonwealth of Virginia, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of Commonwealth of Virginia. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Commonwealth of Virginia; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.
- Winner Information: After the Grand Prize winner is selected and confirmed, information about the Grand Prize winner will be posted on www.gerber.com and Gerber’s verified social media pages.
